Legal framework
Trademarks in Oman are governed by the Industrial Property Rights Law (adopted by Royal Decree No. 67/2008).
By virtue of Royal Decree No. 33 of 2017 promulgating the Law of Trademarks for the GCC States (the GCC Trademarks Law), Oman became the fourth GCC nation to adopt the GCC Trademarks Law as of July 25, 2017. The GCC Trademark Law’s implementing rules, however, have not yet been released by Oman.
Oman is a party to the Madrid Protocol, making it feasible to extend an existing worldwide trademark registration via the Madrid System.
Classification of Goods and Services: 11th Edition of Nice Classification (NCL).
Opposition Period: 90 days from the publication date. Extension of the opposition period is not possible.
Protection Period: 10 Years.
Renewal: A registered mark is renewable for successive periods of 10 years within the last year of protection.
Grace Period for Renewal: A grace period of 6 months is allowed for the renewal with a lateness fine following the expiry of the registration period.
Use of trademarks: It is not compulsory for registration or maintaining the registration in force. However, as per Article 42/2 of Industrial Property Rights Law, any interested party may request the Registrar to cancel the mark if the mark has not been used by the registered owner or a licensee during a continuous period of three (3) years or longer.
Mandatory Documentation
TM Registration
- A Power of Attorney filled with the full name and address of the applicant, duly notarized and legalized up to the Omani Consulate or certified by the Apostille.
- A copy of the Certificate of incorporation, or an extract of the commercial register, or business license along with its Arabic translation.
- Certified copy of the priority document (in case of claiming priority).
- Description of the goods or services to be covered by the application.
- Clear prints of the mark.
TM Renewal
- A Power of Attorney legalized up to the Omani Consulate or certified by the Apostille.
- A copy of the registration Certificate.
Name Change/Address Change Recordal
- A Power of Attorney in the new name and/or address legalized up to the Omani Consulate or certified by the Apostille.
- A certificate of change of name/address (which is applicable) legalized up to the Omani Consulate or certified by the Apostille.
Recordal of Assignment/Merger
- A Deed of Assignment legalized up to the Omani Consulate or certified by the Apostille.
- A Power of Attorney from the Assignee legalized up to the Omani Consulate or certified by the Apostille.
- Copy of the Registration Certificate for the purpose of endorsement.
- Copy of Certificate of Incorporation or business license.
