Regulatory Body
Patents in Kuwait are administered by the ‘Trademarks and Patents Department’ of the Ministry of Commerce and Industry.
Legal Framework
The provisions of Law No. 4 of 1962 relating to Patents, Designs and Industrial Models as amended by Law No. 3 of 2001, are the governing Laws of patents in Kuwait.
Kuwait has issued Law No. 11/2016 approving the accession of Kuwait to the Patent Cooperation Treaty (PCT). But, the Kuwaiti Patent Office stopped accepting new patent applications as of April 4, 2016. The only option left was to register the patents via GCC Patent Office. However, the Kuwaiti Patent Office has started accepting patent applications from February 27, 2018 onward.
Patent Cooperation Treaty (PCT)
Kuwait became one of the contracting parties to the PCT when it deposited its instrument of accession on June 9, 2016. The Treaty came into force on September 9, 2016.
Accordingly, any international application filed on or after September 9, 2016, designated Kuwait (KW) can enter the National Phase in Kuwait. However, the Kuwaiti Patent Office started accepting the national phase entry of the PCT on March 27, 2018.
Filing Options
There are two ways in which a patent can be filed in Saudi Arabia:
- 1.National Filing at Saudi Patent Office. Priority can be claimed within 12 months of the first application (Paris Convention).
- 2.National Phase Entry of PCT application, within 30 months from the priority date.
- 3.Through the Gulf Cooperation Council Patent Office (GCCPO), within 12 months from the priority date.
NB: The GCC patent office has started new applications on behalf of Bahrain (BH) and Kuwait (KW) starting January 1, 2023.
The GCCPO will conduct the formal and substantive examinations and transfer the patents to national patent offices for a grant.
Other Info
- PCT National Phase: Acceptable within 30 months from the date of initial filing.
- Priority Term: Within 12 months from the priority filing date.
- Protection period: 20 years from the date of filing the application or from the international filing date for the national phase entry of PCT applications.
- Annual fees: Due at the beginning of each calendar year (January 1 to March 31).
Mandatory Documentation (Filing)
- Simply signed POA from the applicant(s).
- General Information Required:
- Name and address of the applicant(s).
- Name and address of the inventor(s).
- Details of the Priority Application(s).
- Arabic translation of the specification, including the Abstract, claims, and drawings (if any).
- A Power of Attorney executed by the applicant(s), duly notarized and legalized up to Kuwaiti Consulate.
- Deed of Assignment (if applicable) executed by the inventor(s), duly notarized and legalized up to Kuwaiti Consulate.
- An extract from the Commercial Register or Certificate of Incorporation duly legalized up to Kuwaiti Consulate.
- A certified copy of the priority document(s) along with its Arabic translation.
- We handle translations of patent documents from English to Arabic.
- We require only e-copies of the aforementioned documents.
