Regulatory Body
The Department of Industrial Property, which is under the Ministry of Economy, oversees patent law in the United Arab Emirates.
Legal Framework
The Federal Law No. 44 of 1992 for Organising and Protecting Industrial Property for Patents, Designs, and Industrial Models, which was abolished by the Federal Law No. 31 of 2006 modifying the Law No. 17 of 2002, provided patent protection in the United Arab Emirates.
The seven emirates of Abu Dhabi, Dubai, Sharjah, Fujairah, Ras-Al-Khaimah, Umm-Al-Quwain, and Ajman are all covered by a patent awarded under the UAE federal legislation.
Patent Cooperation Treaty (PCT)
The Government of the United Arab Emirates deposited its instrument of accession to the Patent Cooperation Treaty (PCT) on December 10, 1998. The Treaty came into force on March 10, 1999.
Filing Options
There are two ways in which a patent can be filed in the UAE:
- 1.National Filing at the UAE Industrial Property Office. Priority can be claimed within 12 months of the first application (Paris Convention).
- 2.National Phase of PCT applications, within 30 months from the priority date.
NB: The GCC Patent Office (GCCPO) has stopped accepting new patent filings as “GCC Patent” as of January 6, 2021.
Other Info
- PCT National Phase: Acceptable within 30 months from the date of initial filing.
- Priority Term: Within 12 months from the priority filing date.
- Protection period: 20 years from the date of filing the application or from the international filing date for the national phase entry of PCT applications.
- Annual fees: No official fee. Annuity is due on the anniversary of the national filing date. For national phase applications, annuities are due on the anniversary of the international filing date.
A period of six months is allowed for attending the Annuity. However, the last 3 months of which are grace periods subject to a penalty.
Mandatory Documentation (Filing)
As of the filing date
- A copy of the specification in English and Arabic in MS Word format, including the Abstract, claims, and drawings (if any).
- Simply signed POA from the applicant(s).
- General Information Required:
- Name and address of the applicant(s).
- Name and address of the inventor(s).
- Details of the Priority Application(s).
Supporting Documents
- A Power of Attorney executed by the applicant(s), duly notarized.
- A deed of Assignment (if applicable) executed by the inventor(s), duly notarized.
- An extract from the Commercial Register or the Certificate of Incorporation, duly notarized. For Individual applicants, a a passport copy of the applicant is required.
- A certified copy of the priority document(s) along with its Arabic translation.
Note:
- We handle translations of patent documents from English to Arabic.
- We require only e-copies of the aforementioned documents.
