Patent Registration in Oman

Patent registration in Oman is essential for inventors seeking to safeguard their intellectual property. The Sultanate of Oman provides a comprehensive framework for patent registration, granting inventors exclusive rights over their inventions. By filing a patent application with the Department of Intellectual Property, applicants can obtain legal protection for their novel concepts.

In Oman, the patent registration procedure involves multiple steps and requires meticulous documentation. Applicants must submit a detailed description of their invention, as well as supporting illustrations and patent claims that define the scope of the patent. The Intellectual Property Department evaluates the patent application based on a variety of factors, including novelty, inventiveness, and industrial applicability.

Patent Renewal in Oman

Renewal must occur on time to guarantee continuous protection and prevent potential infractions. Patent proprietors must adhere to the prescribed renewal procedures and satisfy the Intellectual Property Department’s deadlines.

Once the patent has been granted, it is crucial to maintain vigilance regarding its renewal. Patent proprietors must keep track of their renewal dates and pay the required fees to preserve their exclusive rights. The invention may be exposed to potential infringement if the patent is not renewed within the specified timeframe.

Regulatory Body

The Intellectual Property Department of the Ministry of Commerce and Industry governs patents in Oman. 

Legal Framework

The Patent Law, which was implemented in 2000 by Royal Decree No. 82/2000, was created to safeguard patents (for inventions) and other IP regulations.

The Industrial Property Rights statute (enacted by Royal Decree No. 67/2008) abolished this statute, and Royal Decree No. 132/2008 amended some of its provisions.

Patent Cooperation Treaty (PCT)

Accession by the Sultanate of Oman to the Patent Cooperation Treaty (PCT) was completed on July 26, 2001, and came into force on October 26, 2001.

Accordingly, any international application filed on or after October 26, 2001, designated Oman (OM) can enter the national phase in Oman.

Filing Options

There are two ways in which a patent can be filed in Oman:

  • 1.National Filing at the Oman Patent Office. Priority can be claimed within 12 months of the first application (Paris Convention).
  • 2.National Phase Entry of PCT application, within 30 months from the priority date.

NB: The GCC Patent Office (GCCPO) has stopped accepting new patent filings as “GCC Patent” as of January 6, 2021.

Other Info

  • PCT National Phase: Acceptable within 30 months from the date of initial filing.
  • Priority Term: Within 12 months from the priority filing date.
  • Protection period: 20 years from the date of filing the application or from the international filing date for the national phase entry of PCT applications.
  • Annual fees: Annuities are paid before the anniversary of the national filing date for non-PCT applications. For PCT national phase applications, annuities must be paid well before the anniversary of the international filing date.


Mandatory Documentation (Filing)

As of the filing date
  1. A copy of the specification in English and Arabic in MS Word format including the Abstract, claims, and drawings (if any).
  2. General Information Required:
    1. Name and address of the applicant(s).
    2. Name and address of the inventor(s).
    3. Details of the Priority Application(s).
Supporting Documents
  1. A Power of Attorney executed by the applicant(s), duly notarized and legalized up to Omani Consulate or attested by the Apostille.
  2. Deed of Assignment (if applicable) executed by the inventor(s), duly notarized and legalized up to the Omani Consulate or attested by the Apostille.
  3. An extract from the Commercial Register or Certificate of Incorporation, duly legalized up to Omani Consulate or authenticated by the Apostille. For individual applicants, a passport copy of the applicant is required.
  4. A certified copy of the priority document(s) along with its Arabic translation.
